General Terms and Conditions and Important Information

I. Contract

1. Registration, Realisation of Contract, Payment Due Date
1.1. Event participation is generally only possible following previous registration.
1.2. You can register for our events in person, by telephone, in writing or online. Fees are generally paid by the SEPA Direct Debit Scheme or by credit card. If you register in person, you can additionally pay in cash or by EC card.
1.3. Your registration for the events run by Münchner Volkshochschule is binding and the fee is payable at once. If the SEPA Direct Debit Scheme is used, you will be notified of the debit date in writing at least two calendar days in advance. If you cancel the debit authorisation or if the bank fails to execute the direct debit transaction, you must bear the bank charges incurred.
1.4. If you register in person, you will receive your registration card directly after payment. For all the other means of registration, you will generally receive your registration card per email. Please make sure the email address you provide is active and check any spam filters used. In case no email address, to which your registration card can be sent, has been provided, your registration card will be sent per post. Please note that an event can only be attended with a valid registration card. Registration cards cannot be transferred.
1.5. Subsequent invoicing in the name of third parties is not possible. Invoices will not be issued for tickets to single ticket events.
1.6. Please note the separate instructions for the respective courses and the conditions of withdrawal applicable to registrations for courses run by the department for basic education and school examinations, for language examinations and for Celta and Delta courses.
1.7. The entire course fee is due, even if the course is missed in whole or in part. This also applies in the event of premature termination of the course or subsequent entry to courses already in progress.

2. Scope of Services
2.1. The event description found in the programme exclusively states the event content. Oral promises or descriptions are non-binding. Tutors are not entitled to make individual arrangements.
2.2. Münchner Volkshochschule reserves the right to have events held by other tutors. If there is a practical reason to do so, Münchner Volkshochschule can change the time and venue or individual date(s) of an event, insofar as this is not unreasonable for the participants.

3. Events Involving Travel
Study trips and excursions organised by a third party as the contractual partner do not fall under the jurisdiction of Münchner Volkshochschule. The terms of trade of the travel organiser in question apply. In these cases no contractual relationship is created between the Münchner Volkshochschule and the customer.

4. Coupons, Transferability and Redemption Deadline
Münchner Volkshochschule coupons are not personal, they can be used up to ten years after the purchase date, are not redeemable in cash and cannot be redeemed at the box office or for the “Offenes Programm” (open programme).

5. Loyalty Cards
Our loyalty cards are valid for the duration of the programme only, they are not transferable and cannot be cancelled. You may only put your rights to revocation into use after the purchase of a loyalty card by telephone or online.


II. Contract Amendments

6. Cancellation by the Münchner Volkshochschule, Cancellation of an Event
6.1. Events may fail to take place or be cancelled by the Münchner Volkshochschule if
a) the teacher is unable to hold the event, or
b) the required minimum number of students has not been reached
c) important reasons, such as forces majeures.
If an event fails to be held, the Münchner Volkshochschule shall notify you immediately.
If it takes you a long time to reach your event, please check in advance with the registration office that the event is taking place.
6.2. If an event is cancelled, we will naturally refund you for the fee you have paid. Cash refunds are not possible unless the fee was paid in cash.
6.3. If the number of participants on an event is limited, Münchner Volkshochschule reserves the right to over-occupy the event, insofar as this is not unreasonable for the participants in consideration of the content and concept of the event.

7.Cancellation by the Participant, Changing Event
7.1. Should you be unable to attend the registered event, cancellation is only possible provided that you
a) give written notification that you wish to cancel the event no later than one working day before the second session in the case of events with more than seven sessions,
b) give written notification that you wish to cancel the event no later than seven working days before the first session in the case of events with seven or less sessions.
c) for events in Haus Buchenried you must give written notification that you wish to cancel the event no later than 18 working days before the event is due to start.
7.2. Cancellation of pre-booked single tickets and tickets for the open programme is not possible.
7.3. If you withdraw, the fee you have paid will be refunded, less the amounts stated under 7.4. Cash refunds are not possible unless the fee was paid in cash.
7.4. A cancellation charge of € 10.–, although at most the full fee, will be retained for each booked seat for an event along with the proportionate fees for teaching units already held. Money you have already expended (e.g. on materials or tickets) will not be refunded. You are entitled to demonstrate that Münchner Volkshochschule incurred lower losses or none at all.
7.5. Please note that in order to keep to deadlines and calculate proportional fees, receipt of written notification by the Münchner Volkshochschule is essential. Your tutor is not authorised to accept this notification.
7.6. It is not possible to withdraw for other reasons (e.g. own illness or a change of tutor).
7.7. Notification of your cancellation over the phone or directly to your tutor, or failing to appear for the event, are not valid methods of cancellation.
7.8. Changing an event once it has already begun is only possible if the cancellation conditions are adhered to and only if there is a place available in the requested event. If you would like to change event, the fee paid for the old event, minus the amounts set out in point 7.4, shall be credited to the fee payable for the new event.
7.9. The right of extraordinary termination with immediate effect, if there is an important reason to do so, remains unaffected.


III. Further Conditions of Contract

8. Copyright
Due to copyright restrictions, please note that photographing, filming or recording is not allowed at any event. Teaching material may only be utilised and, in particular, copied, distributed or publicly recited with the written authorisation of the Volkshochschule.

9. Liability, Notification Duty
The Münchner Volkshochschule is only liable in the event of gross negligence or intent on behalf of the Münchner Volkshochschule or its agents. Notwithstanding the above, the Münchner Volkshochschule is also liable in cases of ordinary negligence where there is injury to life, limb or health, as well as in the case of a breach of fundamental contractual obligations.
Should any health risks (present allergies, health risks during pregnancy) arise during your participation to an event, it is your obligation explicitly to notify the Münchner Volkshochschule about the risks before the beginning of the event.

10. Communications to the Münchner Volkshochschule
10.1. All communications aimed at the Münchner Volkshochschule can be addressed to the registration offices listed in the programme either in person or in writing.

IV. Important Information

11. Advice and Placement Tests
Before registration, you have the opportunity to consult the department for advice. Particularly designated events require preliminary consultation and placement tests.
Please note that it is not possible to attend an event on a trial basis.

12. Discounted Fees
12.1. Prerequisites for obtaining a discount
Only one discount is possible. Discounts are not granted on one-to-one lessons, trips, material costs, exam fees, meals, accommodation or the MVHS-Card (see 5.).
A prerequisite for obtaining a discount is that you present the registration card and the documents demonstrating your entitlement to a discount when making the booking, or subsequently at the latest before the event ends in person at the registration offices, or send these to us by email (see 10.2.).

12.2. Discounts in Normal Cases
Except in special cases (see 12.3.), the following discounts on event fees are granted at present:
50% discount:

  • upon presentation of München-Pass or Landkreis-Pass (district of Munich) or Landkreis-Pass in surrounding districts.
  • People with a current Asylum Seeker status on presentation of the necessary documents
  • Pensions with an income up to € 1.660.– for singles (€ 2.490.– for couples), and a fortune up to € 20.000.– (€ 30.000.– for couples) only for courses „Senioren Volkshochschule“

20% discount for the following:

  • school pupils, students, trainees, apprentices and interns,
  • the severely handicapped with a degree of disability of 50 or above (in case of registration B, no charge for the accompanying carer; carers of the severely handicapped only pay for accommodation and meals at events in Haus Buchenried),
  • employees of the City of Munich (duty ID card), volunteers working for the Federal Voluntary Service (Bundesfreiwilligendienst), those performing a voluntary social year or a voluntary ecological year.

12.3. Exceptions

  • Event fees for the Junge Volkshochschule (for children and young people) are already reduced, no further discount is possible.
  • A discount can be granted on the fees for school examination courses upon application. Please apply to the department running the programme.

13. Payment of Materials
Our tutors buy materials (excluding textbooks) for their respective events with their own means. Payment for these materials shall be collected at the event. The cost of materials for some events are due at the time of enrolment in order to buy the required provisions before the course begins.
Please address any complaints about materials to the tutors.
We recommend not buying any event material or textbooks until it has been confirmed that the event will actually take place.
Discounts cannot be granted on costs of materials (see section 12.1).

14. Advertising and Selling
Please note that advertising third party products and services and offering wares of any kind commercially and for payment is prohibited in the events of the Münchner Volkshochschule. You, the participant, are not obliged to buy any merchandise. We request that you notify the Münchner Volkshochschule immediately of any violation of this provision.

15. For Adults
The Münchner Volkshochschule is an institution established to provide adult education. We therefore hope you understand that children and young people may attend events only if the event description explicitly states so.

16. Childcare Services
16.1. For programmes marked „children”, the Münchner Volkshochschule offers childcare services. Children aged between 18 months and six years are cared for by trained and experienced staff.
16.2. Should you require childcare services, please notify us as soon as possible (telephone 0 89/4 80 06-65 50). We will be very happy to speak to you about the option of your child attending a trial session before the event begins.
16.3. There is no entitlement to childcare services. The Münchner Volkshochschule reserves the right to refuse childcare in individual cases.

17. Wheelchair Access
Events which are accessible for wheelchair users are marked „wheelchair” in the programme. However, it is our aim to also make the other events accessible for wheelchair users.

18. No-Smoking Policy
Please note that there is a general no-smoking policy in place on all our premises.

19. Pets
No pets are allowed in the courses. This applies to all events. Guide dogs (for the blind) are an exception.

20. Guests in the Schools
The Münchner Volkshochschule, the teachers and the participants are guests in the schools. We therefore call your attention to the school rules and regulations.

21. Data Protection
Personal data are recorded, stored and processed solely for our own administrative purposes and in accordance with the data protection law. You will find our data protection policy statement at www.mvhs.de/data-privacy-statement.


V. Particular Conditions for the Use of Computers

22. Use of Computers
Additional conditions apply to all events in which computers are used. These are regulated in a separate agreement concluded between Münchner Volkshochschule and participants at the start of the event. Verbal, auxiliary agreements or promises are invalid. Our tutors are not authorised to amend the conditions of contract.

23. Use of Software
23.1. Programs made available within the context of the event are not to be modified, copied, distributed or made publicly accessible in any way. The use of such programs is only permitted for the purpose of event participation.
23.2. If this provision is not complied with, the participant is liable for resulting damages.

24. Internet Access
24.1. If the Münchner Volkshochschule provides Internet access, this is only to be used within the context of the event. Web pages of a pornographic, racist or discriminatory nature are not to be accessed.
24.2. If this provision is not complied with, the participant is liable for resulting damages.

25. Loss of Data, Computer Viruses
25.1. Each participant is responsible for the protection of their own data. The Münchner Volkshochschule shall not assume liability for loss of data.
25.2. The Münchner Volkshochschule shall not assume liability for damages caused by the use of acquired knowledge or through the use of created or modified programs, or through computer viruses or other destructive programs.
25.3. Points 25.1 and 25.2 are not applicable in case of major negligence or intent on behalf of the Münchner Volkshochschule or its agents.


VI. Final Provisions

26. Final Provisions
26.1. Should individual provisions of the contract or of these terms and conditions become invalid, either in full or in part, the remaining parts of the contract shall hereby remain valid.
26.2. The MVHS reserves the right to amend these terms and conditions with effect for the future.
26.3. The publication of these terms and conditions renders all previous versions invalid.
