General Terms and Conditions and Important Information

I. Contract

1. Enrolment, Realisation of Contract, Payment Due Date
1.1. Course participation is generally only possible following previous ­enrolment (Exceptions: one-off and open events).
1.2. You can enrol for our courses in person, by telephone, in writing, or online. Payment is in cash, by EC card, or by direct debit. If enrolment is by telephone, in writing, or online, payment is solely by direct debit.
1.3. Enrolment to any Münchner Volkshochschule course or event is binding and subject to immediate payment. If the granted permission for direct debit is contested or the instructed bank does not carry out the direct debit, the enrollee bears all fees and charges.
1.4. You shall receive your enrolment card by email or post. Please note that a course or an event can only be attended with a valid enrolment card. The enrolment card is not transferable.
1.5. Subsequent invoicing in the name of third parties is not possible.

2. Scope of Services
2.1. The course description found in the programme exclusively states the course content. Oral promises or descriptions are non-binding.
Tutors are not entitled to make individual arrangements.
2.2. The Münchner Volkshochschule reserves the right to have courses conducted by a different tutor.

3. Trips
The Münchner Volkshochschule does not organise trips. Should the Münchner Volkshochschule act as an intermediary, the general terms and conditions of the trip organiser should, in any case, be noted. A contrac­tual relationship shall only come into being with the trip organiser. The respective terms and conditions of the trip organiser shall then apply.

4. Computer Use
For all courses in which computers are used, additional conditions apply which are set out in a separate agreement. This agreement between the Münchner Volkshochschule and the participant is concluded at the beginning of the course. Oral agreements and promises have no validity. Our tutors are not entitled to change any provision of the contract. Otherwise, the conditions stated in section V. shall apply.

II. Contract Amendments

5. Cancellation by the Münchner Volkshochschule, Shortened Duration of a Course, Cancellation of a Course
5.1. Courses and events can fail to be held or can be cancelled by the Münchner Volkshochschule
a) if the tutor is unable to hold the course, or
b) if a required minimum number of students fail to enrol.
If a course fails to be held, the Münchner Volkshochschule shall notify you immediately.
If it takes you a long time to reach your course, please check in advance with the enrolment office that the course is taking place.
5.2. Fees paid for courses cancelled by the Münchner Volkshochschule will, of course, be refunded. Refunds can only be made in cash if the course fee was paid either in cash or with an EC card. Refunds can only be given after an enrolment card has been shown.
5.3. Courses with fewer than the required minimum number of students enrolled by the third session shall be shortened. The content and overall concept of the course will not be affected.
Participants who are unhappy with a course being shortened are able to withdraw from the course, provided they do so in writing, no later than one working day before the fourth session. They shall then receive the course fee, minus a proportional amount for sessions which have already taken place.
5.4 Should there be a limit to the number of participants in a course, MVHS reserves the right to make up to 2 overbookings.

6. Cancellation by the Participant, Changing Course
6.1. Should you be unable to attend the enrolled course, cancellation is only possible provided that you
a) give written notification that you wish to cancel the course no later than one working day before the second session in the case of courses with more than seven sessions.
b) give written notification that you wish to cancel the course no later than seven working days before the first session in the case of courses with seven or less sessions.
6.2. Cancellation of pre-booked one-off events (identified in the programme) is not possible.
6.3. If there is a cancellation you shall be refunded the paid course fee, minus the amounts set out in section 6.4. Refunds can only be made in cash if the course fee was paid either in cash or with an EC card. Refunds can only be given after an enrolment card has been shown.
6.4. In all cases of cancellation, 10 per cent of the total tuition fee, however a minimum of € 5.– or a maximum of € 25.–, will be charged as a handling fee. In addition to this, a proportional amount shall be retained to cover classes which have already taken place.
Out-of-pocket expenses already incurred (i.e. payment of materials or booked tickets) shall not be reimbursed.
6.5. Please note that in order to keep to deadlines and calculate proportional fees, receipt of written notification by the Münchner Volkshochschule is essential. Your tutor is not authorised to accept this notification.
6.6. Withdrawal from the course for other reasons, i.e. illness or change of tutor, is not possible.
6.7. Notification of your cancellation over the phone or directly to your tutor, or failing to appear for the course, are not valid methods of cancellation.
6.8. Changing a course once it has already begun is only possible if the cancellation conditions are adhered to and only if there is a place available on the requested course. If you would like to change course, the fee paid for the old course, minus the amounts set out in point 6.4, shall be credited to the fee payable for the new course.

III. Further Conditions of Contract
 
7. Copyright

Due to copyright restrictions, please note that photographing, filming or recording is not allowed at any event. Teaching material may only be utilised and, in particular, copied, distributed or publicly recited with the permission of the Volkshochschule.

8. Liability
8.1. The Münchner Volkshochschule is only liable in the event of gross negligence or intent on behalf of the MVHS or its agents. Notwithstanding the above, the Münchner Volkshochschule is also liable in cases of ordinary negligence where there is injury to life, limb or health, as well as in the case of a breach of fundamental contractual obligations.
8.2. In the event of a disturbance or accident, participants agree to make reasonable efforts to remedy the disturbance or to keep damage to a minimum.

9. Communications to the Münchner Volkshochschule
9.1. All communications aimed at the Münchner Volkshochschule can be addressed to the enrolment offices listed in the programme either in person or in writing.

IV. Important Information
 
10. Advice and Placement Tests

Before enrolment, you have the opportunity to consult the department for advice. Particularly designated courses require preliminary consultation and placement tests. Please note that it is not possible to attend a course on a trial basis.

11. Discounted Fees
11.1. Conditions of a discount
Only one discount is possible. The discount guidelines apply for courses costing more than € 20.–, provided that nothing is stated to the contrary for the course.
Discounts are not granted on one-to-one lessons, trips, material costs, exam fees or the MVHS card.
A discount can only be granted if the student presents their registration card and documents, which are proof of entitlement to discount, at the time of booking, or in person at the enrolment office at a later date but not after the end of the course.
11.2. Discounted amount
The following discounts on course fees are currently granted:
50 per cent discount upon the presentation of a München-Pass or Freizeitpass (this does not apply to events at Haus Buchenried)
20 per cent discount off the full price upon the presentation of a München-Pass or Freizeitpass for events being held at Haus Buchenried
20 per cent discount for students (school, university), apprentices and trainees up to the age of 26, handicapped persons with a 50 per cent degree of handicap or higher (accompanying person free-of-charge in the case of category B handicap), staff of the Landeshauptstadt München (with service card), individuals serving in the federal volunteer programme (Bundesfreiwilligendienst) and those engaged in a voluntary social year or voluntary ecological year (without age restriction). Also valid for seminars in Haus Buchenried (off the full price).
11.3 Further Provisions
The entitlement to discount can only be recorded, upon request, for handicapped participants in possession of an unlimited, valid disability card. For more information, please contact the enrolment office.
Partial payment is possible upon application (in writing) if the course runs for at least eight weeks and the tuition fee is more than € 250.–. In this case, payment of 50 per cent of the total sum is due upon enrolment with the remainder being due within one month after the course has begun.

12. Special Enrolment Provisions
For enrolment in the Ökologisches Bildungszentrum, in Haus Buchenried, in the subject area Barrierefrei lernen and in the department Grundbildung und Schulabschlüsse, please note the special information on the respective course offers.

13. Payment of Materials
Our tutors buy materials (excluding textbooks) for their respective courses with their own means. Payment for these materials shall be collected in the course.
The cost of materials for courses within the subject area Kochkultur und Weinkunde are due immediately at enrolment to allow tutors to buy the required provisions in good time before the course begins.
Please address any complaints about materials to the tutors.
We recommend not buying any course material or textbooks until it has been confirmed that the course will actually take place.
Discounts cannot be granted on costs of materials (see also section 11., Discounted Fees).

14. Advertising and Selling
Please note that advertising third party products and services and offering wares of any kind commercially and for payment is prohibited in the courses of the Münchner Volkshochschule. You, the participant, are not obliged to buy any merchandise. We request that you notify the Münchner Volkshochschule immediately of any violation of this provision.

15. For Adults
The Münchner Volkshochschule is an institution established to provide adult education. We therefore hope you understand that children and young people may attend events and courses only if the course description explicitly states so.

16. Childcare Services
16.1. For programmes marked Auf Anfrage Kinderbetreuung, Telefon (0 89) 72 10 06-12 the Münchner Volkshochschule offers childcare services at the address Lindwurmstrasse 127 Rgb (rear building) an Schwanthaler Straße 40. Children between the ages of two and six are cared for by trained, experienced staff.
16.2. Should you require childcare services, please notify us as soon as possible (telephone 0 89/ 72 10 06-12). We will be very happy to speak to you about the option of your child attending a trial session before the course begins.
16.3. There is no entitlement to childcare services. The Münchner Volkshochschule reserves the right to refuse childcare in individual cases.

17. Wheelchair Access
Courses which are accessible for wheelchair users are marked   in the programme. However, it is our aim to also make the other courses accessible for wheelchair users.

18. No-Smoking Policy
Please note that there is a general no-smoking policy in place on all our premises. This particularly applies to all course rooms.

19. Pets
No pets are allowed in the courses. This applies to all events.

20. Guests in the Schools
The Münchner Volkshochschule, its course instructors, and course participants are guests in the schools. We wish to continue our good working relationship with the school janitors, to whom we are very grateful for their cooperation. We therefore call your attention to the most important points of the school rules and regulations and request that you follow them carefully:
Handle the classrooms, furniture and equipment with care.
Keep the school premises clean.
Do not smoke on school premises.
Use the allocated restrooms.
No pets allowed on school premises.
Please leave the classrooms orderly, close the windows and switch off the lights when leaving.
Evening programmes must end by 9 pm.
Do not erase what is written on boards. Usually there is a special board for the use of Münchner Volkshochschule courses, which must be erased after class.
If tables and chairs are moved, please return them to their original places at the end of the class. The children will be grateful. There is no entitlement to other, larger rooms.
Use only the school facilities (furniture, equipment, etc.) provided for your course and do not remove these items from the ­respective rooms.
No parking on school premises. The city of Munich assumes no ­liability for any personal injury or material damage occurring on school premises.
Please help us to continue to be welcome guests in the school buildings.

V. Particular Conditions for the Use of Computers
 
21. Use of Software

21.1. Programs made available within the context of the course are not to be modified, copied, distributed or made publicly accessible in any way. The use of such programs is only permitted for the purpose of course participation.
21.2. If this provision is not complied with, the participant is liable for resulting damages.

22. Internet Access
22.1. If the Münchner Volkshochschule provides Internet access, this is only to be used within the context of the course. Web pages of a pornographic, racist or discriminatory nature are not to be accessed.
22.2. If this provision is not complied with, the participant is liable for resulting damages.

23. Loss of Data, Computer Viruses
23.1. Each participant is responsible for the protection of their own data. The Münchner Volkshochschule shall not assume liability for loss of data.
23.2. The Münchner Volkshochschule shall not assume liability for damages caused by the use of acquired knowledge or through the use of created or modified programs, or through computer viruses or other destructive programs.

VI. Final Provisions
 
24. Final Provisions
24.1. Should individual provisions of the contract or of these terms and conditions become invalid, either in full or in part, the remaining parts of the contract shall hereby remain valid.
24.2. The MVHS reserves the right to amend these terms and conditions with effect for the future.
24.3. The publication of these terms and conditions renders all previous versions invalid.
